The Economic and Financial Crimes Commission has dismissed claims of political bias in its handling of the investigation involving former Attorney General of the Federation and Minister of Justice, Abubakar Malami, insisting that its actions are strictly guided by law and due process.

The anti graft agency made the clarification in a statement issued by its spokesperson, Dele Oyewale, following reports suggesting that Malami’s bail was revoked because of his alleged attendance at a political gathering in Kebbi State.

According to the EFCC, such claims are false and misleading, stressing that its operations remain apolitical. The commission explained that it was compelled to respond despite its usual reluctance to engage media narratives around ongoing investigations.

Oyewale stated that Malami was granted administrative bail after a brief interrogation on November 28, 2025, but the bail was provisional and subject to specific conditions. He noted that the former minister had not met any of the five conditions attached to the bail, nor shown willingness to comply with them.

“Administrative bail is a discretionary temporary reprieve that allows a suspect to be released on stated conditions pending the conclusion of investigation and arraignment in court,” the EFCC said. “To this effect, after his brief interrogation on November 28, 2025, Malami was offered provisional bail hinged on five requirements. He has neither met any of the requirements nor shown readiness to keep faith with them.”

The commission further disclosed that Malami was expected to return for further interrogation on December 1, 2025. However, the date was later shifted following a letter from him dated December 4, in which he appealed for consideration on health grounds.

The EFCC said it granted the request on compassionate grounds, even though the bail conditions remained unmet. It added that Malami failed to provide any medical report or credible evidence to support his claim of ill health.

“He was initially required to commence reporting for further investigations on December 1, 2025, but this had to be deferred largely owing to his request for an adjournment on grounds of ill health. He neither provided a medical report nor credible proof of ill health to the commission,” the statement added.

The EFCC maintained that the investigation has nothing to do with politics, emphasizing that all suspects are treated equally, regardless of status or political affiliation.
